Tax Mechanics

Tax-Loss Harvesting & Loss Utilization

Loss harvesting is not simply selling positions that are down. Wash sales, capital-loss carryovers, gains, portfolio objectives, state rules, and future transactions should be coordinated.

Tax-loss harvesting is useful only when the harvested loss can improve the taxpayer’s current or future position without undermining the investment plan. The practitioner should distinguish generating a tax loss from actually using it.

Confirm basis and holding period

A loss calculation depends on reliable basis, corporate actions, reinvestments, inherited or gifted property rules and lot identification. Do not harvest a loss that cannot be supported.

The wash-sale rule follows replacement exposure

Buying substantially identical securities before or after the sale can defer the loss and adjust basis. Review transactions in multiple accounts and consider spouse activity and IRA purchases where relevant.

Capital-loss capacity is a tax attribute

Losses first offset gains under the netting rules; only a limited net capital loss offsets ordinary income annually, with the remainder carried forward. A taxpayer with large existing carryovers may receive little incremental current benefit from creating more loss.

Investment economics come first

Remaining out of a desired position merely to preserve a tax loss can create market risk. The practitioner should coordinate with the investment professional and avoid presenting a tax rule as an investment recommendation.

Use the carryover deliberately

Future gain recognition, concentrated-position diversification, business sales and charitable decisions can create opportunities to use a capital-loss carryover. Track it as a permanent tax attribute.

Planning takeaway

Harvest losses only when the tax attribute has a purpose.

Verify basis, wash-sale exposure, existing carryovers and the investment objective, then document how the loss is expected to be used.
